Today, on December 16, the Supreme Court reduced the sentences
of Mónica Caballero and Francisco Solar, accused of placing a bomb in
the El Pilar basilica in Zaragoza in October 2013, repealing the
initial 12-year sentence handed down by The National Audience to 4
years and 6 months.
This decision was made after partially accepting an appeal brought by
the defence of comrade Francisco Solar, in which he asked that he not
be convicted on charges of terrorist damage and injury
separately as though they were the result of two different actions, as it
was originally in the National Court. In addition, the defence pointed out that
they took care when they placed the small artefact of
homemade manufacture in an attempt to attack a religious symbol as
element of established power, that they did not intend to
cause injury to any person. This thesis was reinforced claiming that
at the time of the attack that area of the basilica was closed to
the public and that, in addition, the device did not contain shrapnel
and that they warned of its placement before it detonated.
In addition to the reduction in the sentence the costs were also lowered
from 182.601 to 143.317 euros, as in the damage caused in the basilica of
El Pilar there was no evidence that this affected goods of historical or cultural value.
The Audiencia Nacional considered that both anarchists acted
“autonomously” as they are not considered as participating in
either the FAI / FRI informal organization or the Coordinated
Anarchist Groups (GAC) platform.
Faced with this news we cannot contain the great joy of the new
situation of our comrades, but who could face new scenarios, such as being
expelled for being “foreigners” with a sentence of under 6 years,
but for the moment we prefer to wait for the next moves of our
enemies, and to see them in the streets again.
